This document describes the terms and
conditions governing the use of this Internet
access. You are the end user hereinto referred
to as ("User"). By signing up for the
service, you accept all of the terms and
conditions ("Terms and Conditions")
set forth below and authorize us to provide the
Services (as defined below) for a period agreed
to upon placing an order for the Services (the
"Initial Term").
PLEASE CAREFULLY READ AND REVIEW THE TERMS
AND CONDITIONS BEFORE USING THE EQUIPMENT OR THE
SERVICE. BY USING THE SERVICES YOU ARE BECOMING
A PARTY TO AND AGREE TO BE BOUND BY THIS
AGREEMENT. YOU FURTHERMORE ACKNOWLEDGE THAT YOU
HAVE READ AND UNDERSTAND THE TERMS AND
CONDITIONS AND AGREE TO BE BOUND BY THE TERMS
AND CONDITIONS IN EFFECT AND AS UPDATED BY US
FROM TIME TO TIME. IN ADDITION, BY PLACING AN
ORDER FOR THE SERVICES, YOU ACKNOWLEDGE THAT WE
WILL COMMENCE PROCESSING SUCH ORDER AND WILL
INCUR EXPENSES AND OBLIGATIONS IMMEDIATELY.
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS
AND CONDITIONS, YOU MAY NOT USE THE SERVICES AND
YOU SHOULD CANCEL YOUR ORDER. IF YOU DO NOT
AGREE TO BE BOUND BY THE TERMS AND CONDITIONS,
WE WILL BE UNDER NO OBLIGATION TO PROVIDE YOU
WITH THE SERVICES.
THE TERMS AND CONDITIONS ARE SUBJECT TO
REVISION FROM TIME TO TIME.
- Computer
Equipment
User agrees to
purchase network access services
("Services") from us. We or our
contractor has provided User with materials,
which set forth the minimum hardware and
operating system requirements necessary to use
the Services. User represents and agrees that
User has reviewed those materials and that the
computer in which the Equipment will be
installed meets these minimum requirements.
- Equipment
Provided
We, or our agent or
contractor may provide User with a radio, an
antenna, and certain software (collectively the
"Equipment"). The
Equipment provided by us, if installed and used
properly, allows the User to access and use the
Services.
- Services
Services provided by
us are for the sole use of the User and not for
resale of any kind without the prior written
consent from us, which may be given at our sole
discretion. In
the event the User attempts to resell the
Services, we may, at our sole discretion,
increase the fees associated with the Services,
or terminate the Services.
- Billing
User agrees to pay
all charges to User’s account, including
recurring fees, applicable taxes and charges to
recover taxes paid, in accordance with billing
terms in effect at the time the fee or charge
becomes payable. User agrees to provide us with
accurate and complete billing information,
including User’s legal name, address,
telephone number and credit card information..
The recurring fee is due and payable in advance
of the respective billing period for which the
User has purchased Services, with the first
payment due and payable on the activation date
of the Services. User agrees to pay a fee for
processing unpaid checks or rejected credit
cards. Activation and usage fees are
non-refundable. The initial payment may include
non-recurring installation charges including,
but not limited to equipment and activation
fees. Delinquent accounts are subject to
immediate termination or suspension of Services
at the sole discretion of us. If payment is not
received by us within fifteen (15) days from the
date payment is due, User’s account is
considered delinquent and User will be subject
to a late payment fee of 1.5% per month of the
outstanding balance on User’s account or $15
dollars, whichever is greater (not to exceed the
maximum rate permitted by law). User is also
responsible for all attorney and collection fees
arising from our efforts to collect any unpaid
balance.

Terms of Payment
A
credit card User agrees to allow Mainline
Wireless to bill his or her card on each
successive billing date without obtaining User's
permission after the initial charge. User
agrees to report to us all changes to this
information within thirty (30) days of any
change, including any change in the expiration
date of User’s credit card.
If
the card is not honored for any reason, Mainline
Wireless will attempt to notify the card holder
by using the telephone information given at
sign-up or by E-mail. Mainline Wireless will
call the card holder, and if alternative billing
has not been established, the account will be
terminated. Restoring the account will be
subject to a setup fee of $10.00.
If
payment is by check, payment due dates are
indicated on User's invoice. Dishonored checks
are subject to a collection fee to be determined
by Mainline Wireless in its sole and absolute
discretion and User's account may be suspended
until the account is current. If payment is not
received, service will be terminated. Restoring
the account will be subject to a setup fee of
$10.00.
- Intended
Use of the Services
User acknowledges
and agrees that the Services are for personal
use and agrees not to use the Services in a
manner prohibited by any federal or state law or
regulation. User further agrees to adhere to our
Acceptable Use Policy ("AUP") which is
available on our website. Transmission of any
material in violation of federal or state law or
regulation, including, but not limited to any
copyrighted material, material protected by a
trade secret or material or messages that are
unlawful, harassing, libelous, abusive,
threatening, harmful, vulgar, obscene or
otherwise objectionable in any manner or nature
or that encourages conduct that could constitute
a criminal offense, give rise to civil liability
or otherwise violate any applicable local,
state, national or international law or
regulation, is prohibited.
User acknowledges
that there is content on the Internet or
otherwise available through the Services which
may be offensive, or which may not be in
compliance with all local laws, regulations and
other rules. We assume no responsibility for and
exercises no control over the content contained
on the Internet or is otherwise available
through the Services. All content accessed or
received by the User is used by User at his or
her own risk, and we and our employees shall
have no liability resulting from the access or
use of such content by the User.
- System
and Network Security
Users may not
attempt to circumvent user authentication or
security of any host, network, or account (also
known as "cracking"). This includes,
but is not limited to, accessing data not
intended for the User, logging into a server or
account the User is not expressly authorized to
access, or probing the security of other
networks.
Users may not
attempt to interfere with service to any user,
host, or network ("denial of service
attacks"). This includes, but is not
limited to; "flooding" of networks,
deliberate attempts to overload a service, and
attempts to "crash" a host.
Users may not use
any kind of program/script/command, or send
messages of any kind, designed to interfere with
a user's terminal session, via any means,
locally or by the Internet.
Users who violate
systems or network security may incur criminal
or civil liability. We will cooperate fully with
investigations of violations of systems or
network security at other sites, including
cooperating with law enforcement authorities in
the investigation of suspected criminal
violations.
Users understand
that there are certain security risks by
utilizing wireless 802.11b networks. We are
committed to maintaining a public network for
ease of use and make no guarantees or
representations regarding the security of our
network. We recommend the use of personal
firewall software and a VPN client to attach to
private networks. As an option, we support
routable IP addresses to all connection types to
support a corporate VPN. Additional information
about personal firewalls, VPN’s, and other
security precautions can be found on our FAQ
website.
- Privacy;
Monitoring the Services
We are under no
obligation to monitor the services, but we may
do so from time to time and we may disclose
information regarding User’s use of the
Services for any reason and at our sole
discretion in order to satisfy applicable laws,
regulations, governmental requests, or in order
to operate and deliver the Services in an
effective manner, or to otherwise protect us and
our Users. We agree to comply with the terms of
our Privacy Policy as set forth on our FAQ
website, as it may be amended from time to time.
8. Restrictions
Users agree not to
run any servers in conjunction with the
Services, including but not limited to,
electronic mail, NAT, DHCP and DNS servers. In
the event any User attempts to utilize a server
on the network, we may, at our sole discretion,
increase the fees associated with the Services,
or terminate the Services.
9. Term /
Cancellation
User agrees to
maintain Services for the duration of the
Initial Term. After the Initial Term, Services
shall automatically renew for successive periods
equivalent to the Initial Term. User may
terminate the Services at the end of the Initial
Term or at any time during any renewal term by
providing not less than thirty (30) days written
notice to us. Termination notice must be sent to
the address located on our website.
Cancellation during the Initial Term is
subject to a cancellation fee of $250.00.
10. Reconnect Fee
If the Services are
terminated due to non-payment and/or breach of
the Terms and Conditions or ACCEPTABLE USE
POLICY, User agrees to pay a reconnection fee,
if Services are reactivated.
11. System Back-ups
Mainline
Wireless does not and will not perform system
backups on any User's E-mail account(s).
Mainline Wireless shall not be held responsible
for any lost E-mail data, email attachments, or
any E-mail message contents, regardless of the
reasoning for data loss or system causes. Except
as otherwise set forth herein, Mainline Wireless
will not provide historical data, to any party
for any reason, regarding any system or Internet
activity.

THE SERVICES
PROVIDED BY US ARE PROVIDED "AS IS."
WE MAKE NO WARRANTY OF ANY KIND, EXPRESSED OR
IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY
WARRANTY OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE OR NON-INFRINGEMENT, OR ANY
WARRANTY REGARDING THE RELIABILITY OR
SUITABILITY FOR A PARTICULAR PURPOSE OF ITS
SERVICES. USER UNDERSTANDS AND ACKNOWLEDGES THAT
WE EXERCISE NO CONTROL OVER THE NATURE, CONTENT
OR RELIABILITY OF THE INFORMATION AND/OR DATA
PASSING THROUGH OUR NETWORK. NO ORAL OR WRITTEN
INFORMATION OR ADVICE GIVEN BY US, ITS DEALERS,
AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY AND
USER MAY NOT RELY ON ANY SUCH INFORMATION OR
ADVICE. WE MAKES NO WARRANTY OF ANY KIND, EITHER
EXPRESSED OR IMPLIED, REGARDING THE QUALITY,
ACCURACY OR VALIDITY OF THE INFORMATION AND/OR
DATA RESIDING ON OR PASSING THROUGH ANY NETWORK.
USE OF ANY INFORMATION AND/OR DATA OBTAINED FROM
OR THROUGH SERVICES PROVIDED BY US WILL BE AT
USER’S OWN RISK. USER ACKNOWLEDGES THAT WE ARE
NOT LIABLE FOR ANY ERRORS OR INTERRUPTION IN THE
INSTALLATION PROCESS OR IN PROVIDING THE
SERVICES, WHETHER WITHIN OR OUTSIDE THE CONTROL
OF US. UNDER NO CIRCUMSTANCES SHALL THE USER
HOLD US OR ANY OF OUR AGENTS, CONTRACTORS OR
REPRESENTATIVES RESPONSIBLE FOR ANY FORM OF
DAMAGES OR LOSSES (INCLUDING WITHOUT LIMITATION
ANY DIRECT, INDIRECT, CONSEQUENTIAL OR
INCIDENTAL DAMAGES OR LOSSES) SUFFERED FROM, BUT
NOT LIMITED TO ERRORS, DELAYS, LOSS OF
INFORMATION, DELAYS IN THE INSTALLATION OR
PROVISIONING PROCESS, OR INTERRUPTIONS IN THE
SERVICES CAUSED BY THE USER, US OR A THIRD
PARTY’S NEGLIGENCE, FAULT, MISCONDUCT OR
FAILURE TO PERFORM. USER UNDERSTANDS THAT
TELECOMMUNICATION AND/OR NETWORK ACCESS SERVICES
MAY BE TEMPORARILY UNAVAILABLE FOR SCHEDULED OR
UNSCHEDULED MAINTENANCE AND FOR OTHER REASONS
WITHIN AND OUTSIDE OF THE DIRECT CONTROL OF US.
UNDER NO CIRCUMSTANCES DO ANY SUCH ERRORS,
DELAYS, INTERRUPTIONS IN SERVICES OR LOSS OF
INFORMATION NULLIFY OR MODIFY THESE TERMS AND
CONDITIONS. WE RESERVE THE RIGHT TO REFUSE OR
TERMINATE SERVICES TO A USER AT ANY TIME WITHOUT
CAUSE. THE INTERNET CONTAINS UNEDITED MATERIALS,
WHICH MAY BE SEXUALLY EXPLICIT, OR MAY BE
OFFENSIVE TO YOU OR OTHERS ACCESSING THE
SERVICES. WE HAVE NO CONTROL OVER SUCH MATERIALS
AND ACCEPT NO RESPONSIBILITY FOR SUCH MATERIALS.
- User
Complaint Resolution
In order to resolve
a complaint regarding the Services or to receive
further information regarding the use of the
Services, User should contact us at the address
and phone number listed on our website.
- Additional
Terms and Conditions
We may, from time to
time, send e-mail messages or other forms of
communication to User containing advertisements,
promotions, etc. which may be offered by third
parties. We make no representation or warranty
with respect to the content of any such third
party communications or goods or services which
may be obtained in response to such
communications and User agrees that we shall not
have any liability with respect thereto, nor
shall any such messages amend the Terms and
Conditions unless specifically agreed to in
writing by us. Additionally, our web site may
contain links to Web sites operated by parties
other than us. Such links are provided for your
convenience only. We do not control such Web
sites and is not responsible for their contents.
Our inclusion of links to such Web sites does
not imply any endorsement of the material on
such Web sites or any association with their
operators.
- Entire
Agreement
The Services Order
Confirmation and Acknowledgement Terms and
Conditions, the Terms and Conditions, the
Acceptable Use Policy and the Privacy Policy
contain the entire agreement and understanding
concerning the Services and supersede all prior
negotiations, proposed agreements, and all other
agreements, whether electronic, written or oral.
The Terms and Conditions may be modified at any
time by us and the latest version of the Terms
and Conditions may be found on our FAQ website.
A printed version of these Terms and Conditions
and of any notice given in electronic form shall
be admissible in judicial or administrative
hearings based upon or relating to the Terms and
Conditions to the same extent and subject to the
same conditions as other business documents and
records originally generated and maintained in
printed form.
- Assignment
and Successors in Interest
All of the Terms and
Conditions shall be binding upon, inure to the
benefit of, and be enforceable by the respective
successors and permitted assigns of User. Except
as specifically stated herein, neither these
Terms and Conditions nor any of the rights,
interests or obligations of User or us shall be
assigned or delegated without the prior written
consent of us. Any unauthorized assignment or
delegation shall be null and void.
Notwithstanding the foregoing, we may assign or
otherwise transfer its rights and obligations to
any affiliate (whether by purchase of stock or
assets, merger, operation of law, or otherwise)
of that portion of its business related to the
subject matter hereof.
- Venue/Choice
of Law
These Terms and
Conditions shall be construed in accordance with
the laws of the State of
Illinois
(excluding rules regarding conflicts of law) and
the
United States of America
. In the event of any dispute, the parties
submit to the personal jurisdiction of and venue
in the Superior Court of the state of
Illinois
and the federal courts located in
Illinois
- Severability
In the event that it
is determined by a court of competent
jurisdiction as a part of a final non-appeasable
judgment that any provision of these Terms and
Conditions (or part thereof) is invalid,
illegal, or otherwise unenforceable, such
provision will be enforced as nearly as possible
in accordance with the stated intention of the
parties, while the remainder of the Terms and
Conditions will remain in full force and effect.
- Indemnification
User
shall indemnify and hold us harmless against any
and all claims, losses, damages and liabilities
sustained by User resulting from, rising out of,
or connected with any breach of, or
non-fulfillment of any representation, warranty,
covenant or agreement made by or other
obligation of User contained in these Terms and
Conditions.

Mainline Wireless’s Acceptable Use
Policy ("AUP") is provided
to give our customers & users a
clear understanding of what Mainline
Wireless expects of them while using
our Broadband Internet Service
(“Service”). All users of our
Service; those who access some of
our Service but do not have direct
accounts with us, as well as those
who pay a service fee to subscribe
to our Service, must comply with
this AUP.
Use of Mainline Wireless’s
Broadband Internet Service
constitutes acceptance and agreement
of Mainline Wireless’s AUP.
AUP
General Information
We
support the uncensored flow of
information and ideas over the
Internet and do not actively monitor
subscriber activity under normal
circumstances. Similarly, we do not
exercise editorial control over the
content of any web site, e-mail
transmission, newsgroups, or other
material created or accessible over
or through the services, except for
certain proprietary Web sites.
However, in accordance with our TOS
(Terms of Service), we may remove
any materials that, in our sole
discretion, may be illegal, may
subject us to liability, or which
may violate this AUP. Mainline
Wireless may cooperate with legal
authorities and/or third parties in
the investigation of any suspected
or alleged crime or civil
wrongdoing. Your violation of this
AUP may result in the suspension or
immediate termination of either your
Mainline Wireless account or other
actions as detailed in Section 3
WITHOUT PRIOR NOTICE.
This document is intended to provide
a basic understand of Mainline
Wireless’s Acceptable Use Policy.
The following are guidelines for the
establishment and enforcement of
Mainline Wireless’s AUP:
- Ensure
reliable service to our
customers
- Ensure
security and privacy of our
systems and network, as well as
the networks and systems of
others
- Comply
with existing laws
- Maintain
our reputation as a responsible
service provider
- Encourage
responsible use of the Internet
and discourage activities which
reduce the usability and value
of Internet services
- Preserve
the value of Internet resources
as a conduit for free expression
and exchange of information
- Preserve
the privacy and security of
individual users
Mainline
Wireless intends to provide its
customers access to everything the
Internet has to offer. While
Mainline Wireless is firmly
committed to the principles of free
speech, certain activities that may
be damaging to the resources of both
the Mainline Wireless and the
Internet and cannot be permitted
under the guise of free speech. The
resources of Mainline Wireless and
the Internet are limited, and abuse
of these resources by one user has a
negative impact on the entire
community.
We do not routinely monitor the
activity of accounts except for
measurements of system utilization
and the preparation of billing
records. However, in our efforts to
promote good citizenship within the
Internet community, we will respond
appropriately if we become aware of
inappropriate use of our service.
You may not use your site to publish
material, which Mainline Wireless
determines to be unlawful, indecent
or objectionable. For purposes of
this policy, "material"
refers to all forms of
communications including narrative
descriptions, graphics (including
photographs, illustrations, images,
drawings, logos), executable
programs, chat programs, video
recordings, and audio recordings
(MP3 files). Excessive
storage of MP3 files & Video
files are not permitted as these
files consume excessive resources on
our servers.
If
you're not the copyright holder of
the material placed on your site
(unless the material is public
domain) please do not place this
material on your virtual site as
this will result in the possible
cancellation of your account. For
purposes of this policy,
"material" refers to all
forms of communications including
narrative descriptions, graphics
(including photographs,
illustrations, images, drawings,
logos), executable programs, video
recordings, and audio recordings
(MP3 files).
NO ADULT
orientated, Streaming Media, Chat or
Warez material may be stored on your
virtual site.
If a Mainline Wireless account is
used to violate our AUP, we reserve
the right to terminate your service
without notice. We prefer to advise
customers of inappropriate behavior
and any necessary corrective action,
however, flagrant violations of the
Acceptable Use Policy will result in
immediate termination of service (we
will refund any unused hosting term
left on your account). Our failure
to enforce this policy, for whatever
reason, shall not be construed as a
waiver of our right to do so at any
time.
As a member of our network
community, you must use your
Internet access responsibly.
VIOLATIONS
OF MAINLINE WIRELESS ACCEPTABLE USE
POLICY
The following constitute violations
of this AUP:
- Illegal
use: Mainline Wireless’s
Service may not be used for
illegal purposes, or in support
of illegal activities. Mainline
Wireless reserves the right to
cooperate with legal authorities
and/or injured third parties in
the investigation of any
suspected crime or civil
wrongdoing.
- Harm
to minors: Use of the Mainline
Wireless service to harm, or
attempt to harm, minors in any
way, including, but not limited
to child pornography.
- Threats:
Use of the Mainline Wireless
service to transmit any material
(by e-mail, uploading, posting
or otherwise) that threatens or
encourages bodily harm or
destruction of property.
- Harassment:
Use of the Mainline Wireless
Service to transmit any material
(by e-mail, uploading, posting
or otherwise) that harasses
another.
- Fraudulent
activity: Use of Mainline
Wireless service to make
fraudulent offers to sell or buy
products, items, or services, or
to advance any type of financial
scam such as "pyramid
schemes," "ponzi
schemes," and "chain
letters."
- Forgery
or impersonation: Adding,
removing or modifying
identifying network header
information in an effort to
deceive or mislead is
prohibited. Attempting to
impersonate any person by using
forged headers or other
identifying information is
prohibited. The use of anonymous
re-mailers or nicknames does not
constitute impersonation.
- Unsolicited
commercial e-mail / unsolicited
bulk e-mail (SPAM) Use of the
Mainline Wireless service to
transmit any unsolicited
commercial or unsolicited bulk
e-mail is expressly prohibited.
Violations of this type will
result in the immediate
termination of the offending
Mainline Wireless account.
- E-mail
/ News Bombing: Malicious intent
to impede another person's use
of electronic mail services or
news will result in the
immediate termination of the
offending Mainline Wireless
account.
- E-mail
/ Message Forging: Forging any
message header, in part or
whole, of any electronic
transmission, originating or
passing through the Mainline
Wireless service is in violation
of this AUP.
- Usenet
SPAMing: Mainline Wireless has a
zero tolerance policy for the
use of its network for the
posting of messages or
commercial advertisements, which
violate the rules, regulations,
FAQ or charter of any newsgroups
or mailing list. Commercial
messages that are appropriate
under the rules of a newsgroup
or mailing list or that are
solicited by the recipients are
permitted.
- Unauthorized
access: Use of the Mainline
Wireless service to access, or
to attempt to access, the
accounts of others, or to
penetrate, or attempt to
penetrate, security measures of
Mainline Wireless’s or another
entity's computer software or
hardware, electronic
communications system, or
telecommunications system,
whether or not the intrusion
results in the corruption or
loss of data, is expressly
prohibited and the offending
Mainline Wireless account is
subject to immediate
termination.
- Copyright
or trademark infringement: Use
of the Mainline Wireless service
to transmit any material (by
e-mail, uploading, posting or
otherwise) that infringes any
copyright, trademark, patent,
trade secret or other
proprietary rights of any third
party, including, but not
limited to, the unauthorized
copying of copyrighted material,
the digitization and
distribution of photographs from
magazines, books, or other
copyrighted sources, and the
unauthorized transmittal of
copyrighted software.
- Collection
of personal data: Use of the
Mainline Wireless service to
collect, or attempt to collect,
personal information about third
parties without their knowledge
or consent.
- Network
disruptions and unfriendly
activity: Use of the Mainline
Wireless Service for any
activity which affects the
ability of other people or
systems to use Mainline Wireless
Services or the Internet. This
includes "denial of
service" (DOS) attacks
against another network host or
individual user. Interference
with or disruption of other
network users, services or
equipment is prohibited. It is
the Member's responsibility to
ensure that their network is
configured in a secure manner. A
Subscriber may not, through
action or inaction, allow others
to use their network for illegal
or inappropriate actions. A
Subscriber may not permit their
network, through action or
inaction, to be configured in
such a way that gives a third
party the capability to use
their network in an illegal or
inappropriate manner.
Unauthorized entry and/or use of
another company and/or
individual's computer system
will result in immediate account
termination. Mainline Wireless
will not tolerate any subscriber
attempting to access the
accounts of others, or penetrate
security measures of other
systems, whether or not the
intrusion results in corruption
or loss of data.
- Fraud:
Involves a knowing
misrepresentation or misleading
statement, writing or activity
made with the intent that the
person receiving it will act
upon it.
- Infringement
of Copyright, Patent, Trademark,
Trade Secret, or Intellectual
Property Right: Distribution
and/or posting of copyrighted or
the aforementioned infringements
will not be tolerated.
- Distribution
of Viruses: Intentional
distributions of software that
attempts to and/or causes
damage, harassment, or annoyance
to persons, data, and/or
computer systems are prohibited.
Such an offense will result in
the immediate termination of the
offending account.
- Inappropriate
Use of Software: Use of software
or any device that would
facilitate a continued
connection, i.e. pinging, while
using Mainline Wireless services
could result in
suspension/cancellation of
service.
- Third
Party Accountability: Mainline
Wireless subscribers will be
held responsible and accountable
for any activity by third
parties, using their account
that violates guidelines created
within the Acceptable Use
Policy.
Security
You are responsible for any misuse
of your account, even if the
inappropriate activity was committed
by another user under you account,
friend, family member, guest or
employee. Therefore, you must take
steps to ensure that others do not
gain unauthorized access to your
account. In addition, you may not
use your account to breach security
of another account or attempt to
gain unauthorized access to another
network or server.
- Your
password provides access to your
account. It is your
responsibility to keep your
password secure.
- Sharing
your password and account access
with unauthorized users is
prohibited. You should take care

your account since you will be
held responsible for such use.
- Attempting
to obtain another user's account
password is strictly prohibited,
and may result in termination of
service.
- You
must adopt adequate security
measures to prevent or minimize
unauthorized use of your
account.
- You
may not attempt to circumvent
user authentication or security
of any host, network or account.
This includes, but is not
limited to, accessing data not
intended for you, logging into
or making use of a server or
account you are not expressly
authorized to access, or probing
the security of other networks.
Use or distribution of tools
designed for compromising
security is prohibited. Examples
of these tools include, but are
not limited to, password
guessing programs, cracking
tools or network probing tools.
- You
may not attempt to interfere
with service to any user, host
or network ("denial of
service attacks"). This
includes, but is not limited to;
"flooding" of
networks, deliberate attempts to
overload a service, and attempts
to "crash" a host.
- Users
who violate systems or network
security may incur criminal or
civil liability. Mainline
Wireless will cooperate fully
with investigations of
violations of systems or network
security at other sites,
including cooperating with law
enforcement authorities in the
investigation of suspected
criminal violations.
Network
Performance
Mainline Wireless’s domain hosted
accounts operate on shared
resources. Excessive use or abuse of
these shared network resources by
one customer may have a negative
impact on all other customers.
Misuse of network resources in a
manner which impairs network
performance is prohibited by this
policy and may result in immediate
termination of your account without
warning.
You are prohibited from excessive
consumption of resources, including
CPU time, memory, disk space and
session time. You may not use
resource-intensive programs which
negatively impact other customers or
the performances of Mainline
Wireless’s systems or networks.
Mainline Wireless reserves the right
to terminate or limit such
activities.
REPORTING
VIOLATIONS OF MAINLINE WIRELESS AUP
Mainline Wireless requests that
anyone who believes that there is a
violation of this AUP to notify
Mainline Wireless at the address
listed on our web site.
If available, please provide the
following information:
- The
IP address used to commit the
alleged violation
- The
date and time of the alleged
violation, including the time
zone or offset from GMT
- Evidence
of the alleged violation
E-mail
with full header information
provides all of the above, as do
system log files. Other situations
will require different methods of
providing the above information.
Mainline Wireless may take any one
or more of the following actions in
response to complaints:
Issue
written or verbal warnings
- Suspend/Terminate
the Member's account
- Terminate
the Member's account
- Bill
the Member for administrative
costs and/or reactivation
charges
- Bring
legal action to enjoin
violations and/or to collect
damages, if any, cause by
violations
REVISIONS
TO THIS ACCEPTABLE USE POLICY
Mainline Wireless reserves the right
to revise, amend, or modify this AUP
and our other policies and
agreements at any time and in any
manner.
